While the IRS remains on track to open the official tax season Wednesday, January 30, 2013, they announced today an additional delay for returns containing Education Credits (Form 8863) including the American opportunity and lifetime learning tax credits.
The IRS website also contains a list of 30 other forms that will delay filing because the forms must be updated and tested to protect taxpayers from processing errors and possible refund delays. The IRS expects to announce soon when returns containing these forms will be accepted, which will probably be late February or early March.
Some of the more common forms that may affect you:
- Form 3800, General Business Credit
- Form 4562, Depreciation and Amortization

- Form 8582, Passive Activity Loss Limitations
- Form 8396, Mortgage interest Credit
- Form 8839, Qualified Adoption Expenses
- Form 8903, Domestic Production Activities Deduction
